Furious Florida Judge Lashes Out as Law Enforcement Disregards Court Order

Florida Attorney General Ashley Moody instructed state law enforcement to cease arrests of migrants under a newly enacted statute amid controversy. This directive came after a federal judge, who had previously issued an order regarding the matter, voiced anger at being disregarded.

Under the new statute, entering Florida without proper authorization now constitutes a first-degree misdemeanor.

However, Williams ordered a pause Following its use to incarcerate a U.S.-born citizen named Juan Carlos Lopez-Gomez in Leon County, questions arose regarding the law. Despite a judge concluding that there wasn’t sufficient evidence for his detention by the Florida Highway Patrol, Immigration and Customs Enforcement held him for 48 hours. He was ultimately freed only after his mother presented his birth documentation.

Initially, Lopez-Gomez's arrest sparked nationwide outrage.

"Until where will the lack of legal constraints within this administration extend? If something like this can occur against a U.S.-born citizen, then none of us are safe," asserted Florida Democratic Party chairman Nikki Fried.

A lawyer defending the plaintiffs who brought charges against Florida concerning the statute cautioned that the state would probably disregard the instruction to halt the detainment of migrants. The legal representative stated, "While we recognize that federal courts have identified this overtly unconstitutional legislation, the truth remains that without proper enforcement measures, it appears as though both local police forces and the Florida Highway Patrol continue to flout the court’s orders."
